By using Presencr ("the Service"), you agree to these terms. If you do not agree, please do not use the Service. Presencr is operated by 9th Avenue.

Description of Service

Presencr is a business presence analysis tool that uses public data from Google and AI to generate reports about a business's online presence, competitors, and website performance. The Service provides informational analysis and recommendations.

Use of the Service

You agree to:

• Use the Service only for lawful purposes
• Provide accurate information when registering or verifying your email
• Not attempt to abuse, overload, or reverse-engineer the Service
• Not use automated tools to scrape or extract data from the Service

Reports and Analysis

Reports generated by Presencr are based on publicly available data and AI analysis. While we strive for accuracy, reports are provided "as is" and should be treated as informational recommendations, not guarantees.

• Business data is sourced from Google Places API and may not reflect the most current information
• AI-generated recommendations are suggestions and should be evaluated in the context of your specific business
• Website performance data is based on Google PageSpeed Insights at the time of analysis

Accounts and Authentication

You may access the Service by verifying your email address or signing in with Google. You are responsible for maintaining the security of your account credentials and for all activity under your account.

Payments and Refunds

If the Service includes paid features, payment terms will be clearly displayed before purchase. All payments are processed securely through third-party payment providers. Refund requests can be made within 7 days of purchase by contacting us.

Intellectual Property

The Service, including its design, code, and branding, is the property of 9th Avenue. Reports generated for you are yours to use. You may not resell or redistribute the Service itself.

Limitation of Liability

Presencr and 9th Avenue are not liable for any indirect, incidental, or consequential damages arising from the use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

Termination

We reserve the right to suspend or terminate access to the Service at our discretion, with or without notice, for conduct that violates these terms or is harmful to other users or the Service.

Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
